General Terms and Conditions (GTC) for Digital Products

§ 1 Scope of Application and Contractual Partner
(1) These Terms and Conditions apply to all contracts regarding digital products (such as e-books, digital guides, blueprints, and educational digital content) ordered via this website and provided by Petra Mayer, Im Grossenbruch 71, 66583 Spiesen-Elversberg, Germany (hereinafter referred to as "Provider").

(2) Please note that the actual purchase, payment processing, and invoicing for our digital products are handled entirely by our authorized reseller: CopeCart Inc., a Florida corporation located at 12050 Lone Cypress Dr, Jacksonville, FL 32223, USA (for US orders), and CopeCart GmbH, located at Rosenstraße 2, 10178 Berlin, Germany (for European orders). CopeCart’s role as a reseller does not constitute an endorsement, approval, or review of this product or any claim, statement, or opinion used in promotion of this product. When purchasing a product, you enter into a binding contractual agreement directly with the respective CopeCart entity under their specific terms of service.

§ 2 Delivery and Access to the Product
(1) RoomHarmony is a purely digital product (E-Book / Digital Guide in PDF format).
(2) Upon successful payment via CopeCart, the product will be made available for immediate download. The download link will be delivered to the Customer via the e-mail address provided during the checkout process. No physical delivery will take place.

§ 3 Prices, Payment and Currency
(1) All prices stated on the Provider‘s website for the United States / International market are final prices in US Dollars (USD). Prices for the European market are processed in Euros (EUR) unless stated otherwise.
(2) Since all transactions are executed by the authorized reseller CopeCart, the payment methods available to the Customer are exclusively determined by CopeCart during the checkout process (e.g., Credit Card, PayPal).
(3) Payment of the purchase price is due immediately upon conclusion of the purchase contract via the reseller's platform.

§ 4 Money-Back Guarantee and Right of Withdrawal (Refund Policy)
(1) For customers purchasing through CopeCart Americas / CopeCart Inc.: We offer a 30-day money-back guarantee for the RoomHarmony Guide. If you are not completely satisfied with your purchase, you have the right to request a full refund within thirty (30) days from the original purchase date by contacting CopeCart Inc. support directly. Upon approval of the refund, your right to use and access the digital guide expires immediately.

(2) For customers located within the European Union purchasing through CopeCart GmbH: You explicitly agree that the execution of the contract begins before the expiry of the legal 14-day withdrawal period, and you acknowledge that your right of withdrawal expires as soon as the digital content download or access has begun. Customers acknowledge that there is no statutory EU-style 14-day right of withdrawal (Widerrufsrecht) available for digital products purchased outside the European Union or by non-EU residents, unless expressly required by local jurisdiction.

§ 5 Intellectual Property and Rights of Use (License)
(1) The Customer does not acquire ownership of the digital content, but a limited, non-exclusive, non-transferable, and revocable license to use the digital content for exclusive personal, non-commercial use.
(2) The Customer is entitled to download the purchased digital content and copy it to their personal end devices.
(3) The Customer is strictly prohibited from modifying, editing, copying for third parties, making publicly accessible, distributing on the Internet or other networks, reselling, or using the content for any commercial purposes without prior written consent from the Provider.
(4) The granting of the rights of use is subject to full and successful payment of the purchase price via CopeCart.

§ 6 Disclaimer of Warranties
(1) The digital products and guides are provided "as is" and "as available" without warranties of any kind, either express or implied, to the maximum extent permitted by applicable law.
(2) While the Provider strives to deliver high-quality and informative digital content based on architectural, interior design, and Feng Shui expertise, the Provider does not guarantee any specific lifestyle, behavioral, psychological, or medical outcomes for your child. The tools and advice provided do not replace professional psychological, pediatric, or medical counseling.
(3) Necessary digital updates (such as fixing typographical errors or technical file updates) may be made available to the Customer at the sole discretion of the Provider.

§ 7 Limitation of Liability
(1) To the maximum extent permitted by applicable law, the Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use or inability to use the digital products.
(2) This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if the Provider has been advised of the possibility of such damage.

§ 8 Data Protection
(1) The Provider values the Customer's privacy. Detailed information on how personal data is collected, stored, and processed (including through email marketing services like GetResponse) can be found in the Provider‘s separate Privacy Policy document linked in the website footer.

§ 9 Choice of Law and Dispute Resolution
(1) The Provider is not participating in alternative consumer dispute resolution procedures before an arbitration board.
(2) These Terms and Conditions and any separate agreements shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. However, if the Customer is a consumer and has their habitual residence in another country (such as the United States), mandatory local consumer protection laws of that country shall remain unaffected.
(3) If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
